Welcome to Condominiuz.com. Our cloud-based software platform is designed to facilitate transparent, efficient, and modern condominium management, including financial management, maintenance tracking, and digital voting systems.
By accessing or using our Platform, services, or any related content, you agree to these Terms and Conditions of Use ("Terms"). If you do not agree with them, you must refrain from using the Service.
These Terms constitute a legally binding agreement between you (whether a property owner, resident, or administrator) and Condominiuz.com, owned by Valoon.uk, London, hereinafter referred to as "Condominiuz."
1. Service Description
Condominiuz offers digital tools for comprehensive condominium management, including:
- Financial control with photographic support for invoices and receipts.
- Visual and documented maintenance activity tracking.
- Online platform for voting and democratic proposals.
- Secure access from web and mobile devices.
The Service is provided "as is," subject to updates and possible interruptions for maintenance. We reserve the right to modify or suspend functionalities, notifying Users with as much advance notice as reasonably possible.
2. Registration and User Accounts
To access the Service’s features, you must register and provide accurate, complete, and up-to-date information (name, email, and contact details). You are responsible for maintaining the confidentiality of your credentials and for all activities conducted from your account.
- Minimum age: You must be at least 18 years old or of legal age in your jurisdiction.
- Representation: If acting on behalf of a condominium, you declare that you have sufficient authority to bind it to these Terms.
- Suspension/termination: We may suspend or terminate accounts in case of non-compliance, misuse, or pending payments.
By registering, you expressly agree to receive emails related to:
- Information and notifications regarding your condominium management.
- Promotional communications exclusively related to the condominium sector, such as insurance for theft, fire, or other common risks, as well as promotions, benefits, or discounts on related products and services.
3. Subscriptions and Payments
The Service operates under a monthly subscription model per housing unit (H/U), with a base price of €3 per unit (plus applicable VAT), with a minimum of 15 units.
- A 30-day free trial is offered with no commitment.
- Payments are made via manual deposit to authorized representatives in each country.
- Renewal is monthly and automatic unless canceled with at least 5 days’ notice.
- Price changes: These will be notified 30 days in advance and will only apply from the next renewal.
- Refunds: No partial refunds are offered, except in cases of justified cancellation by Condominiuz.
- In case of delinquency, access may be suspended until payment is regularized.
4. Permitted Use of the Service
The User may use the Service solely for legitimate purposes related to condominium management. The following are strictly prohibited:
- Illegal, fraudulent, or third-party rights-infringing uses.
- Attempts to hack, inject viruses, overload, or interfere with the Platform.
- Copying, modifying, or redistributing the software without express authorization.
- Sending spam or unauthorized advertising from the Platform.
By uploading content (e.g., invoices, photos, documents), you grant Condominiuz a limited, revocable, worldwide license to host and display such material solely for the operational purposes of the Service.
5. Intellectual Property
Our property: All software, designs, logos, trademarks, and content on Condominiuz.com belong to Valoon Corporation UK or its licensors.
Your content: You retain ownership of the data you upload but grant us the necessary rights to operate the Service. You warrant that such content does not infringe third-party rights.
6. Confidentiality and Data Protection
Condominiuz processes personal data in accordance with its Privacy Policy.
Industry-standard security measures are employed to protect sensitive information, particularly financial data.
Sensitive data: This will only be used for platform purposes and will never be transferred, sold, or shared with third parties, except with strictly necessary service providers (e.g., payment processors) under confidentiality agreements.
Regulatory compliance: Where applicable, the provisions of the GDPR (General Data Protection Regulation of the EU) are adhered to.
7. Warranties and Limitation of Liability
The Service is provided "as is" and "as available," without warranties of merchantability, fitness, or non-infringement.
- Limited liability: Condominiuz and its affiliates shall not be liable for indirect, consequential, or data loss damages.
- Backup: Administrators must maintain external backups of all uploaded information; the Platform is not responsible for accidental losses.
- Exclusions: We assume no responsibility for failures attributable to third parties (e.g., internet providers) or force majeure events.
8. Termination
- By the User: You may cancel at any time by sending an email to accounts@condominiuz.com.
- By Condominiuz: We may terminate the contract in case of serious breach, with 10 days’ prior notice.
- Effects: Upon cancellation, data will be deleted within a maximum of 15 days.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United Kingdom. Any disputes will be resolved exclusively in the courts of London. Prior to this, the parties will attempt to resolve the conflict through negotiation or, failing that, arbitration at the London Chamber of Commerce.
10. Changes to the Terms
Condominiuz may update these Terms to reflect Service improvements or legal requirements. Any significant changes will be notified by email at least 15 days in advance. Continued use of the Platform implies acceptance of such changes.
11. General Provisions
- Severability: The invalidity of one clause does not affect the validity of the others.
- Assignment: You may not transfer your rights or obligations without prior authorization.
- Notifications: These will be made via email to the registered address or to support@condominiuz.com.
